Payment requirements for regular attendance allowance

 

Among those who hold the status of public officials as of January 1 (July 1) and receive a salary, those who are eligible for payment during the period from July 1 to December 31 of the previous year (January 1 to June 30 of the relevant year) ) Public officials whose salaries were paid for more than one month during the period (including public officials who were paid part of their salaries)

 

The first criterion is a person who holds civil servant status on the 1st of the payment month and is paid a salary.

 

For example, public servant A, who took parental leave from May 1, 2016 to July 5, 2016, is reinstated on July 6, 2016. Although he retains his civil servant status on July 1, his salary is not paid. will not be paid overtime pay.

 

The second criterion is that wages must be paid for at least one month in the six-month period immediately preceding the pay month.

When one month is calculated by the inverse method and the periods are added up, 30 days are regarded as one month.

 

For example, a public official who was reinstated on December 3, 2015 is paid December salary, but since he did not work 30 days, it is considered that he has not been paid more than one month salary. Therefore, they are not eligible for the regular attendance allowance in January 2016.

 

A public official for which part of the salary is paid refers to a public official whose status as a public official is maintained due to leave of absence (illness or study abroad), dismissal from position, or absence from work, and the number of days of salary payment continues, but the salary is reduced.

Monthly salary means the monthly salary in the salary table as of January 1st and July 1st of public officials.

For example, even if you were promoted from 7th grade to 6th grade on July 3rd,

Calculation of the number of years of service for full-time allowance

 

The payment rate for regular attendance allowance varies depending on the number of years worked. It is important to calculate the number of years worked. The reference date for service years is the 1st of each month.

 

In the case of educational public officials, the application of service years differs depending on the teaching experience, the career of public officials other than teachers, and similar careers. It can be calculated according to the career conversion rate table for educational officials, etc. in Attached Table 22 of the Public Officials Remuneration Regulations.

 

The years of service of public officials, excluding teachers, can be calculated excluding the following periods:

From the date of execution of the disciplinary punishment, demotion, suspension for 18 months, salary reduction for 12 months, reprimand for 6 months (In case of disciplinary punishment such as receiving gold wind entertainment, embezzlement of public money, and sexual assault, 3 months are added each)

3. The period of leave of absence in the case of being ordered to return to work (Article 57 5-1 of the Ordinance on Appointment of Public Officials)

How to pay regular attendance allowance

 

Regular attendance allowance is not paid to public officials who have received disciplinary measures (reprimand, pay cut, suspension, demotion) during the payment period.

However, if the period of disciplinary action extends over the period subject to payment, attendance allowance shall not be paid only for the period subject to payment to which the day of the disciplinary measure was received, and the subsequent period subject to payment shall not be separately reduced.

 

For example, a public official who received a reprimand on May 1, 2016 cannot receive a regular attendance allowance in July 2016. If a public official received a 3-month pay cut on May 1, 2016, the regular attendance allowance for July 2016 will not be paid, but the full attendance allowance for January 2017 will be paid. Of course, the 3-month salary reduction is not included when calculating the number of years of service when the regular attendance allowance is paid in January 2017.

 

Newly appointed public officials and public officials who have been dismissed or placed on leave of absence are paid according to the actual service period as follows:

During leave of absence, the period of military service, performance of legal duty, employment, study abroad, full-time union position, parental leave (first year), and official sickness leave are regarded as the actual service period.

 

Amount of payment = Amount of regular attendance allowance x Actual service period (months) / 6 (months)

 

Here, the actual working period is 15 days or more, 1 month, and less than 15 days are not counted.
